Purpose and scope<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These General Terms of Use and Sale (hereinafter the \u201cTerms\u201d) aim to define the terms and conditions under which the service <strong>uptimeguard.pro<\/strong> provides users with an IT monitoring solution based on <strong>Uptime Kuma<\/strong>, operated in SaaS (Software as a Service) mode <strong>SaaS (Software as a Service)<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms apply to any use of the Service, whether free or paid, and shall prevail over any other document.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Service description<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Service enables the User to monitor the availability and proper functioning of IT resources such as websites, servers, APIs, network services, or application services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Uptime Kuma is open-source software distributed under its own license. <strong>uptimeguard.pro is neither the author nor the owner of the Uptime Kuma software<\/strong>and acts solely as the hosting provider, operator, and technical integrator of the Service.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. Definitions<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>User:<\/strong> any natural or legal person holding an Account on the Service.<\/li>\n\n\n\n<li><strong>Account:<\/strong> personal space providing access to the Service.<\/li>\n\n\n\n<li><strong>Service:<\/strong> SaaS monitoring solution provided by uptimeguard.pro.<\/li>\n\n\n\n<li><strong>Subscription:<\/strong> paid plan granting access to the Service under defined conditions.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">5. Acceptance of the Terms<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Access to the Service implies full and unconditional acceptance of these Terms. The User acknowledges having the legal capacity required to enter into a contract.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. Access and service availability<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Service is accessible 24\/7, subject to maintenance operations, updates, or events beyond the Publisher\u2019s control.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Service is provided on <strong>a best-efforts basis<\/strong>. No guarantee of continuous availability, absence of errors, or specific performance is provided.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. Account creation and management<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Creating an Account is required to use the Service. The User is solely responsible for the confidentiality of their login credentials.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Publisher reserves the right to suspend or delete an Account, without compensation, in the event of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>violation of these Terms,<\/li>\n\n\n\n<li>abusive or fraudulent use,<\/li>\n\n\n\n<li>threat to the security or integrity of the Service,<\/li>\n\n\n\n<li>non-payment of a Subscription.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">8. Offers and subscriptions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Service is offered through Subscriptions of <strong>indefinite duration<\/strong>, <strong>automatically renewed<\/strong>unless terminated by the user.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Features, limits, and conditions of the plans (Starter, Pro, Enterprise, or equivalent) are detailed on the uptimeguard.pro website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Publisher reserves the right to modify offers and their characteristics, without affecting current Subscriptions before their renewal date.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">9. Financial conditions<\/h2>\n\n\n\n<h3 class=\"wp-block-heading has-large-font-size\">9.1 Pricing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Applicable prices are those in effect on the date of subscription.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Publisher reserves the right to modify its prices at any time. Any price change will be notified to the User with reasonable notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New prices will apply from the <strong>next renewal.<\/strong>If the User refuses the new prices, they may terminate their Subscription before they take effect.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-large-font-size\">9.2 Payment<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Le paiement est exigible \u00e0 l\u2019avance, de mani\u00e8re mensuelle. Il est r\u00e9alis\u00e9 via un prestataire de paiement tiers s\u00e9curis\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any payment failure will result in automatic suspension, followed by termination of the Service without compensation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-large-font-size\">9.3 Renewal<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Subscriptions renew automatically at each billing cycle unless previously terminated by the User.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">10. Right of withdrawal<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In accordance with Article L221-28 of the French Consumer Code, the User acknowledges and agrees that the Service is provided immediately after subscription and expressly waives their right of withdrawal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">11. Termination<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The User may terminate their Subscription at any time from their customer area. Termination takes effect at the end of the current billing period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No full or partial refund will be issued for any started billing period.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">12. User obligations<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The User agrees to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>use the Service in compliance with applicable laws and regulations,<\/li>\n\n\n\n<li>not compromise the security, stability, or performance of the Service,<\/li>\n\n\n\n<li>not use the Service for illegal, fraudulent, or malicious purposes,<\/li>\n\n\n\n<li>own or be duly authorized to monitor the declared resources.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">13. Liability and limitations<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Service is provided \u201cas is\u201d and \u201cas available.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Publisher does not guarantee:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>exhaustive incident detection,<\/li>\n\n\n\n<li>accuracy or immediacy of alerts,<\/li>\n\n\n\n<li>absence of interruptions or errors.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Under no circumstances shall the Publisher be liable for indirect damages, loss of revenue, data loss, or commercial losses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Publisher\u2019s total liability, for all causes combined, is expressly limited to the amount paid by the User during the previous twelve (12) months.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">14. Data and confidentiality<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The User remains the owner of all their data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Data is hosted and processed exclusively for the purposes of the Service. No commercial use is made of it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Personal data processing is described in the Privacy Policy available on the website.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">15. Security<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Publisher implements reasonable technical and organizational measures to protect data. However, the User acknowledges the inherent limitations of any online service.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">16. Intellectual property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Uptime Kuma software remains subject to its open-source license.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All elements specific to the uptimeguard.pro Service (brand, domain name, interface, content) are protected by intellectual property law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">17. Suspension and force majeure<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Service execution may be suspended in cases of force majeure or events beyond the Publisher\u2019s reasonable control.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">18. Modification of the Terms<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Publisher reserves the right to modify these Terms at any time. Users will be informed of any substantial changes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">19.
